He took a drug test(along with others) that was supposed to be confidential. Whoever leaked out this information should be sued to the max. Dont know if it is MLB or the players Union, but whoever it is, they should pay big time. BTW why are the other 100 or so not made public?

I am betting that is not at all how it happened.

Lab records documentation are always contractually obligated to be filed for access by the client for a period of years. Sometimes 5 years, sometimes 7 years, sometimes more. Even if the Players union shredded every bit of the reports once done, I am guessing the lab was contractually obligated to keep the records intact and available to the Union for a period of years, should the union want or need them for whatever reason.

In that contractual time, those records would be I suspect (a lawyer can step in here) made available for discovery under a federal investigation as evidence.

Now who do you blame? Someone in the federal prosecutors office?

If anything, the Union should have negotiated a contract (if at all possible) that called for early document destruction by the lab.

I dont know. If my company requested a drug test and said it would be confidential and it was not, I think they would be liable.....and if it ruined my image and I would go after them.

Isn't Wilton or someone on this board in law school? Maybe they can shed some light on this subject as well. I would be interested to see what his rights would be in a case like this. Is there a legal precedent?

While A-Rod (A-Roid or A-Fraud) might have standing to file a lawsuit, there are some present problems:
(1) Who do you sue?
(2) What are his damages at this time?
(a) lost endorsements?
(b) lost income?

The real practical problem may be finding a sympathetic ear for someone who is making $20M+/year in salary alone who claims that he has somehow been financially damaged because he was caught taking banned substances which may also have been acquired illegally or used illegally by him. Steroid users (oh, excuse me, "banned substance" users) don't have a whole lot of sympathizers at this point - particularly when they have gone to Barbara Walters and denied use of steroids . . . uh, banned substances . . . and then fess up only when the true facts come out.

Yeah, I get your point and its probably technically valid.

However, if a criminal confesses to armed robbery to his priest in a confessional and the priest violates the confidentiality agreement, should the criminal have the right to sue the priest because it resulted in him getting caught for his criminal behavior? Could he sue? Yes. Would he win? Doubtful.

Not knowing a thing about information privacy law, I'll say this: yes, there is a civil cause of action in tort for public disclosure of private information by another, although I don't know what it's called off-hand. The problem with such an action in this case is that the would-be defendant probably has a very good defense: the information was disclosed pursuant to a federal subpoena, and there likely is no privilege that either the players or the lab could have invoked to combat the subpoena successfully.
