Yeah, one could make the argument that MaxBat instigated this. As a bat maker, they should know the rules.

Contract law? Pshaaaah, who needs it when kids, puppies and other good causes are involved.

Let's look at this another way . . .

MaxBats had at least 3 options:
1. It could have manufactured a completely pink bat without any MaxBat label and supplied those bats to Markakis and Plouffe. I don't know what it takes to alter a label but that possibility existed for MaxBat. Heck, it could have generated some positive PR by coming up with creating labelling . . . the breast cancer ribbon . . . "Happy Mother's Day" . . . "Save the TaTas"

2. It could have "pushed the envelope" by making its "Maxbat" label pink while the remainder of that bat was "normally" colored.

3. It could have sought clarification from MLB before deciding on a set strategy.

It chose option #2. Now . . . while I could make a pretty strong argument that bat with a brown maple color barrell and an ash colored handle and a pink "MaxBat" label is not the equivalent of a completely "pink bat," I don't have access to the exclusivity contract between LS and MLB. I also don't have access to the email between MLB and the other bat manufacturers.

Seems to me that options existed for MaxBat (including seeking advance clarification) but it chose not to pursue those options. I'm having a hard time feeling a ton of sympathy here for MaxBat, Markakis or Plouffe. Pretty sure that they could have had a clubhouse attendant/team employee chase down some pink tape to add to their bats if it was a dire situation.
