Braun has a lot of incidental evidence tying him to PED use, but unless MLB can find a direct source, like somebody at the clinic, to pin responsibility on Braun, I think that winning an arbitration case will be difficult.

The evidence will consist solely of somewhat vague records from a clinic, with no witness tying Braun to PED use.

That just isn't true, MLB can do whatever they want but the don't have any balls like Goodell has. You really think MLBPA is going to go nuts to defend steroid users? If anything the MLBPA wants stricter punishments.

MLB cannot do "whatever it wants." It can do what is permitted under the CBA and labor laws.

If MLB suspended Braun based on the notes from the clinic, Braun appeals. Braun would have his lawyer testify about hiring the clinic as a consultant.

If MLB gets no cooperation from anybody at the clinic, that claim would be uncontested. Further, the records from the clinic did NOT indicate, "Braun purchased $10,000 of HGH." Instead:

"Three of the Biogenesis clinic records obtained by Yahoo! Sports show Braun's name. Unlike the players named by the Miami New Times in its report that blew open the Biogenesis case, Braun's name is not listed next to any specific PEDs."

MLB is not going to suspend Braun unless they have more than just the clinic records - which was my original point.

Please, Goodell has no balls. He's New England's doormat. The MLB doesn't have a player conduct policy, does it? Or at least not one that allows the Commish to punish whoever he wants, over whatever he wants. Players in the MLB usually win when they challenge suspensions.

Well yeah, MLB CAN do whatever it wants, as long as it doesn't mind paying out multi-million dollar court settlements when they get sued for violating the CBA.

And ask the Saints if Goodell can get away with doing whatever he wants.

That is my point, the MLBPA is not going to challenge stiffer penalties for roids. They want tougher penalties. They also don't want to be seen as defending steroid users. MLB can hand out stiffer penalties if they want to and I really doubt that the MLBPA will make a big stink.

You're not talking about stiffer penalties. You're talking about convicting a guy using methods outside of the CBA. On top of that, the evidence against Braun is mighty thin. There is no way that the Union is going to play along until there is a ton more evidence. And they're not going to agree with tougher penalties, either, not until they're negotiated and put into the CBA.
